Sheriff Responds to Citizen Concerns: The following is a public statement Pickens Sheriff Donnie Craig posted on social media regarding concerns about the suspect's proximity to Pickens High School. "We have noticed numerous questions regarding the location of Mr. Remlinger’s business since he was a registered Sex Offender. This portion of Georgia Law can get confusing because the specific requirements of a registered sex offender are based upon the time of their offense. As the law would change, it would change for offenders after that date only; not offenders before that time. In the case of Mr. Remlinger, the offense date listed on his indictment was prior to July 2006. Offenders prior to that date were required to register their residence and employment location, but there were no restrictions placed on the proximity of his place of work to schools. Due to this, he was allowed to have a business located near a school.
These same questions relate to his ability to be in the presence of children. During the time of his Probation, which was completed in 2016, there were specific regulations as to when and who he could be around. Once his sentence was complete, these conditions no longer applied because of the date of his offense.
We know that there is a lot of confusion surrounding this topic and wanted to do the best we could to explain it. We are bound by the limitations of law on what we can and cannot enforce as it relates to Sex Offenders. In the event that you are interested in studying the topic further, you can look up O.C.G.A. § 42-1-15, O.C.G.A. § 42-1-16, O.C.G.A. § 42-1-17 for further details (you may want some coffee for the read).
